Commentary - Charlie Crist-Out of Closet On Schiavo
Florida Attorney General Charlie Crist, a Republican candidate for governor, seems to have a lot to say now about the Terri Schiavo case.

Where was he last March when he should have performing the duties of his office?

Answer: Hiding because he didn't want any fallout for the case to descend upon his political future until he could be certain which way the winds and polls were blowing in the Schiavo case.

Last week, during an appearance at the Forum Club of the Palm Beaches in West Palm Beach, Crist said that Gov. Jeb Bush shouldn't have gotten involved in the Schiavo case. Strange position for the Attorney General to take, saying that Gov. Bush shouldn't have made at least the appearance of performing the duties of his office. Bush was statutorily and constitutionally empowered to take the incapacitated woman into protective custody and although he obviously didn't have any real intent to do so because he stupidly called a news conference to announce it, at least be gave the appearance he was trying to do something. That's more than Crist did.

If Crist should unfortunately be elected Governor, when there's a controversial decision to be made, instead of making it, will Crist run and hide in the closet again?

Crist said that government shouldn't be involved in end-of-life decisions. However, Mr. Crist, government---and in particular the attorney general---should be involved in protecting the rights of vulnerable adults and in investigating Medicaid fraud. If you can't perform the duties of as Attorney General, why would the people of Florida ever want you to be their Governor if you only take action if you feel it's politically correct?

As attorney general, Crist is constitutionally charged with protecting the civil rights and liberties of the state's citizens but he did nothing to protect the rights and liberties of Terri Schiavo. He stood idly by and let her be dehydrated to death.

"There are some decisions that ought to be left to God and family", Crist was quoted as saying last week. "Had I been governor, I would not have done the same thing". Good thing you weren't Governor then, and if the voters are smart, you won't be Governor in the future.

Crist consistently stayed out of the Schiavo case although he should have been front and center in the protection of her civil rights. Less than four months after she died a horrific death, Crist had the audacity to call the judges in the Schiavo case "heroes", breaking his silence, saying that he was proud of Pinellas County Court Judge George Greer and U.S. District Court Judge James Whittemore. While he claimed he wasn't endorsing the court rulings against reconnecting Terri's feeding tube which led to her death, others didn't see it that way.

At least Crist's opponent Tom Gallagher had enough courage to take a position, saying that he favored government action to "prevent Terri's starvation". Gallagher said last week that "these kinds of end-of-life matters do not belong in government. But when these kinds of situations come in front of me, I would always err on the side of life. I think that's what you must do when you don't know anything else".

Better than hiding like Crist did while Congress, Gov. Bush, President Bush and the Vatican became involved in the case, pressing to keep Terri Schindler Schiavo alive after Greer and state and federal courts ordered her death because her heavily conflicted husband in name only, Michael Schiavo, said she wouldn't want to be kept alive by a feeding tube. Terri Schiavo sustained incapacitating brain damage in 1990 in still unexplained circumstances. Michael Schiavo said she was in a persistent vegetative state with no chance for recovery, a position her parents disputed. Terri left no living will and her parents said she never would have chosen to die in the matter prescribed for her by the courts and her husband. She died of dehydration on March 31, 2005, 13 days after her feeding tube had been removed.

Crist maintains that he's pro-life.

But you'd never know it. Crist is flip-flopping again.

Last spring Crist said that Gov. Bush wanted to take the lead in the Schiavo case and that the Attorney General's office supported those efforts.

"I don't need to lead where he's (Gov. Bush) is already leading", Crist had said, trying to excuse why he wasn't doing his job. In 1998, in his failed attempt to be U.S. senator, Crist said he was pro-choice.

But now that he's announced that he wants to be Governor, Crist changed his tune and says he's pro-life.

Crist seems to flip-flop a lot on critical issues.

"You try to encourage a culture that respects life but understand that some decisions are up to God and family", Crist says.

And that would include the decision of Mary and Robert Schindler Sr. that their daughter wants to live that they should be the ones caring for her. Michael wasn't "family". He was a husband in name only and a guardian by false application.

The life and death decision should have been made by her family and loved ones, not the mercenary estranged husband and his Hollywood-eyed attorney, George Felos aided and abetted in the judicial homicide by non-partisan Republican good ole boy George Greer.

Crist was and is more afraid concerned for his political future than he was of doing his job. A leopard doesn't change his spots. He'd do the same thing if he were elected Governor, sway whichever way the political wind blew rather than what was best for the people of the state of Floroida.

Charlie Crist seems to talk out of both sides of his mouth. Floridians need a person of good moral character and integrity to lead their state as governor. That individual is not Charlie Crist.

He abandoned Terri Schiavo, he hasn't done his job and in fact, he has been caught red-handed in actually impeding justice in the case and lying to the public.

He blatantly told the public in a televised statement that there had been no complaints of abuse made to the state Department of Children and Families (DCF) a week after a DCF file in the matter was acknowledged in the Schiavo case. He lied to the public.

He said there have been no complaints when there is an envelope containing information about alleged abuse in the Schiavo case which was personally handed to him and which was later returned to the complainant without action---but with Charlie Crist's fingerprints. He cannot honestly say that he was not personally made aware of the alleged abuse, neglect and exploitation of Terri Schiavo. And yet he did nothing.

Is this being pro-life? Is this being honest?

Is this the person you would want to be your state's next Governor?

In one of his newsletters to the public as attorney general, Crist said that "one of the greatest features of our system of democracy is the role government can play in protecting private citizens. Florida's government has a number of safeguards built into it, many of them designed to protect consumers for exploitation".

Those safeguards weren't employed to protect Terri.

Crist didn't protect one of the state's most vulnerable adults from exploitation nor did he take any steps to protect her civil rights.

Maybe it's because Charlie Crist simply doesn't know the law and isn't capable of holding the office of attorney general and certainly not the office of governor. After all, it took him three tries to pass the Florida Bar exam and he seems to have a problem with ethics too, coming under scrutiny of the Florida Elections Commission for allegedly using his office of education commissioner to campaign for the position of attorney general.

The investigation of alleged Medicaid fraud is also within the scope of his AG duties, policing what has become Florida's $12 billion per year Medicaid program.

Despite receiving nearly $600,000 in an insurance settlement and some $750,000 earmarked by a jury to provide rehabilitative services to Terri Schiavo, Michael Schiavo asked Judge George Greer to have Medicaid pay Terri's medical bills. And Greer agreed. Thing is, in that Michael refused to divorce her, how could he own any assets such as he claims he co-owned a house with his concubine and claims in his book that they owned a deli business. Did he declare those assets to Medicaid? If he had assets and was capable of paying for her care, why did he apply to Medicaid and why did Greer allow him to do so. How about it Charlie Crist?

Thing is, Terri Schiavo was placed in a hospice by Michael Schiavo and his lawyer, Felos who was chairman of the board of the hospice at the time. In order to be placed in a hospice legally and for Medicaid to foot the bill, there must be a diagnosis of terminal illness by two doctors and the maximum stay is six months. She was in the hospice for five years.

Why didn't Crist investigate this potential Medicaid fraud? Medicaid fraud can take many forms and cost Floridians hundreds of millions of dollars each year, Crist's own website states. So why didn't his office investigate the Schiavo situation? Oh wait, we know----he was waiting to assess which way the wind blew in terms of political fallout and he determined it was politically advantageous to stay out of the Schiavo case.

In addition to investigating fraud committed by health care providers, the Medicaid Fraud Control Unit of Crist's AG's office also investigates the abuse, neglect and exploitation of the elderly, ill and disabled residents of long term care facilities such as nursing homes, facilities for the mentally and physically disabled and assisted care living facilities.

The investigation of corruption in the administration of the Medicaid program is another important responsibility of the Medicaid Fraud Control Unit, the AG's website says.

Protecting the rights of Terri Schiavo, of all the disabled, elderly and all residents of the state isn't just Gov. Bush's job, it's that of Charlie Crist.

And he didn't do it..

If he can't do the job of attorney general, why does he think he should be Governor? 4-23-06

Update on my Cousin
Whenever there is a bombing in Israel there are so many stories to tell.
Why the victims were there. Why some people who should have been there or were almost there, were not there. The store owners The survivors The dead—and where their lives were heading. And some news outlets have the audacity to focus on the bomber and his ‘desperate situation’ that drove him to mass murder.

This story is about Tuli who sits in Ichalov Hospital in Tel Aviv with a broken leg and a heavy heart as his son Daniel, whose internal organs surrounding his stomach were ripped to shreds, fights for his life.
My cousin Tuli and his son Daniel decided to spend a couple days in Tel Aviv after spending several days in Jerusalem. Along with his wife Cheryl, they were spending Passover in Israel. Their daughter Amanda remained in the states for her university finals. The last time I saw Amanda she was a cute as can be and two years old. I still remember her running around her grandparents’ Miami home 17 years ago. Daniel and our Sharon were still inside their mother’s tummies.
On Monday morning Daniel and Tuli were in a taxi when the driver gave them, what they would find out later to be, tragic advice. “If you like Shwarma, this is the best in Tel Aviv,” referring to the Rosh Ha’ir Shwarma and Falafel stand. Daniel a big fan of the Israeli equivalent to a hamburger (a pita fill with turkey or lamb and lots of other stuff including fries, salad and tehini) turned to Tuli and said, “Dad, we’re coming back here for lunch.” And they did…
And certainly there would be nothing to fear there. Lightning doesn’t strike the same place twice. This restaurant, owned by three brothers, had been attacked just a few months ago by a terrorist. The difference is that lightning doesn’t have demonically, demented intentions. Terrorists do.
As they were eating a fellow with a back pack entered. Smartly, he was stuffing his mouth with food, so his Arab accent would not give him away when he spoke. Dressed with a black t-shirt and jeans, the national uniform for Israeli young men, no one suspected that he was in fact, a Palestinian terrorist.
He placed his bag on the ground and the security guard asked him to open the bag. Tuli noticed all this and did become suspicious when he placed his bag on the ground, but was relieved to see that he was now about to open it for the guard to inspect.
And then the blast.
The guard was ripped in half. Daniel cried out to his father and asked, “Help me up Dad.” But Tuli saw the blood and told him to wait for the paramedics. Then Daniel said, “I love you Dad.” Tuli responded, “I love you too.” He hasn’t spoken since.
Daniel is in intensive care in need of a miracle. Please keep him in prayer.
I heard this story first hand from my cousin this morning from his hospital bed. I used to tell people when they asked me if I was afraid to live here. “Listen, I have never seen a terrorist, I have never heard a bomb go off and no one that I know has ever been in an attack.” I guess I can’t say that last part anymore. Thank you for your prayers for Daniel’s recovery.

The voice on the other end of the line said, "What is the patient's name and room number?"
"Sarah Wells in Room 302," the woman answered.
"I will connect you with the nursing station."
"3-A Nursing Station. How can I help You?"
"I would like to know the condition of Sarah Wells in Room 302."
"Just a moment. Let me look at her records. Oh, yes. Mrs. Wells is doing very well. In fact, she's had two full meals, her blood pressure is fine, her blood work just came back as normal, she's going to be taken off the heart monitor in a couple of hours and, if she continues this improvement, Dr. Murphy is going to send her home Tuesday at noon."

 "Thank God!" the woman said. "That's wonderful! Oh! That's fantastic, that's wonderful news!"
The nurse said, "From your enthusiasm, I take it you must be a family member or a very close friend!"
"Not exactly," the woman said. "I'm Sarah Wells in 302! Nobody here tells me anything."

and unless God removed the scales from Apostolic and Prophetic brethren they
would miss him

and I wept and wept for myself for years preaching that my brethren after
the flesh
had been replaced - how many times I had said this is the holy land as I
pointed to myself
how many times I mocked and raged at those who had a revelation of Israel

and now i found myself learning at their feet - talk about humbling
I knew Gods endtime secrets and now found myself learning from many who were
not even Spirit filled

the more i pressed in the more HS even taught me about myself my personality
my passion for social justice and revolution my intensity my pitbull
tenacity

many of the endtime truths are guarded by what we had already rejected
and tossed out - once i started to understand how God had set a natural
people
and a natural land just because he wanted to

the Word is full of tangibles things so we as humans can get it
like the tabernacle the temple feast days that we can touch and hold

why not a people that he said Jesus said i would divide the nations
sheep/goat how they treat a little nation in the middle east smaller then
michigan

as iran is threatening to nuke Israel and us it behooves us to take another
look
as islam is a bloodthirsty moon demon religion - in my local paper its like
every saturday
the religion editor is trying to get converts

A CALL TO PRAYER - ISRAEL - GAZA - PRESIDENT BUSH
HURRICANE KATRINA - AMERICA I AM CHARGING YOU REPENT
HURRICANE KATRINA - AMERICA I AM CHARGING YOU REPENT
A HARD MESSAGE - A MESSAGE OF FLINT
These past weeks - there have been many strong, clear prophetic voices
concerning Katrina from America declaring the will of the Lord and I rested
in the assuranc e that that there was no necessity for a surplus voice at
this time.

But in an extremely busy period of ministry, suddenly last week I felt the
overshadowing of the Holy Spirit over me concerning this matter and I was
deeply troubled. I sensed the fear of the Lord upon me and I knew that these
could in no way be merely my thoughts or my opinions - it is a fearful and
dreadful thing to attribute things to the hand of the Lord of Hosts that are
merely our own imaginations

That too held me off for days - Father - I said - there are enough voices
out there speaking to this issue - God said - I want you to speak - And it
was a great burden to me because I knew that so many people were suffering
so terribly and that this was a hard message and a message of flint - I
said - Father - If you really want me to I shall - but I said it with great
trepidation over this matter - I also knew that this instance was so
important to Almighty God - that I had to be so accurate in the true
discerning of his purposes a nd his intentions

ECONOMIC DECLINE

But the urgency continued - And as we were driving back home from our
studios in Washington DC to our home in Virginia - I kept seeing in the sky
huge words - ECONOMIC DECLINE and again ECONOMIC DECLINE

Then I saw an enormous hand that almost covered the sky - and I knew that it
was the hand of God Himself and I watched in absolute horror as the hand
started to lift itself - and I felt that the Lord said - I AM ABOUT TO LIFT
MY HAND FROM THIS NATION

It was such a terrible sight and a feeling of terrible dread that overtook
me that I panicked - and I said - Oh Father - NO! You cant lift your hand
from America - America loves you - America serves you - I beg you - Don't
lift your hand from America. And God said - REPENT...

AMERICA - I AM CHARGING YOU - R EPENT

And I said - Father - we are repenting for the decadence of New Orleans -
the body of Christ in America is responding dramatically to this wake up
call - both in mobilizing aid and assistance and also in repentance across
the nation for the complex and many issues that we as the body of Christ
understand led to this disaster -

TWO GREAT AND FESTERING BOIL

Then I saw an awful thing - It is an unpopular and controversial message - I
know -

THE FIRST BOIL - NEW ORLEANS

I saw a great and festering boil in New Orleans and the surrounding area
that had burst and the puss was still oozing and the Lord SAID -

Yes - it is true - my body is repenting for many of the symptoms and the
reason that this boil was able to fester in such a viole nt manner in this
area - and the words came - DECADENCE - HOMOSEXUALITY - LASCIVIOUSNESS -
LAWLESSNESS - RACISM - PRIDE - SODOM AND GOMMORAH - all of which I could see
were boiling and festering in the heart of the boil - but then I saw a small
tip of a very sharp needle move towards it - and the very INSTANT that the
tip of the red hot needle barely even touched the centre of the boil - the
boil erupted with violence because of all the toxic material and poison
already boiling inside.

And it was such an insignificant move - with a seemingly insignificant
tool - but it was the hand of the Lord that caused the boil to erupt -


THE SECOND BOIL - THE MIDDLE EAST AND GAZA DISENGAGEMENT

And then the Lord said - in the same manner - Americas role in the
disengagement of Gaza - has been as a red hot needle to the boil in the
Middle East -I HOLD MY CHURCH IN AMERICA ACCOUNTABLE

To the majority of my body in America - it has been a disregarded and
insignificant move - they have viewed it as a needle - of little effect -
but it has p ierced the boil of the Middle East and I saw the
words -UNLEASHING - BLOODLUST - VENGEANCE - POWER - LUST - GREED -
COVENANT/PACT OF DEATH - HOLOCAUST

AN IGNITION KEY CONDONED BY THE CHURCH THAT LOOSED THE HORDES OF HELL

And somehow I sensed that the fruit of this act by the American Government -
was somehow an IGNITION KEY that had opened the door to release the hordes
of hell and satanic princes to execute a timeline in the Middle East that
would speed up the times of the hunters and pave the way for the next
holocaust - and yet the CHURCH in America - had stood almost VOICELESS -
bound by PASSIVITY and A SPIRIT OF STUPOR -

And then I saw a terrible thing - I s aw millions of Christians all across
the United States of America - with their hands raised - worshipping the
Lord - their faces rapt in worship all across the nation - their bibles in
hand - dressed in Sunday best - their families seated at their side - and
then I heard horrific chilling screams and then I saw right next to them
concentration camps and the scenes of the holocaust and although the screams
were literally bone chilling and the people were screaming for help, not one
of those in the churches even turned their head to look - it was as though a
spirit of passivity and stupor had overtaken them

And the Lord said - "This is what my Church did during the holocaust as the
Jews in Europe burned - They raised their hands and they worshipped me - AND
THIS IS WHAT MY CHURCH HAVE DONE TODAY ONCE MORE BY THEIR OMMISSION OF NOT
SPEAKING OUT AS MY VOICE TO THE GOVERNMENT FOR MY PEOPLE ISRAEL -

EXPEDIENCY - THE OIL

EXPEDIENCY - and the Lord showed me - Oil - and He said "Americas oil became
a target because America sold the nation of Israel out for oil "

And He said - I AM CHARGING AMERICA - REPENT FOR YOUR SINS AGAINS T MY PEOPLE
ISRAEL

I said " O Father -many people will have a hard time believing that the
hurricane in New Orleans is connected with the roadmap and Israel

And God said again - I AM CHARGING AMERICA - REPENT FOR YOUR SINS AGAINST MY
PEOPLE ISRAEL

"For I am stirred up with wrath - says the Lord - that my people have been
forsaken and that my people Israel have been abandoned - For the voices that
whisper peace, peace" - says the Lord God of Hosts - "are not my voices -
and the voices that sue for peace in the Middle East at this time - sue for
expediency says the Lord -

For I have heard the conversations - in the hidden places of the earth - I
have heard the whispers and the strategies and the political expediencies -
and my anger has been stirred on behalf of my people Israel - and yes even
voices in my church arise and say - peace peace - but I tell you - that
pea ce is far from thee and that disaster is near -

For my hand has been stayed - but my hand can be stayed no more - For I tell
you America - that I called you to protect and to preserve and to be as salt
to the nation of Israel - yet you have instigated a covenant of death -

And yet you say that all is well - and yet you say that all is good - and
you say we are a good friend of the nation of Israel - and yet it is under
your watch and it is in this timing and in this season - that my people have
been betrayed

And where is the man and where is the woman and where is the church that
would stand up for my purpose -

For my purpose is not your purpose O Church - And my plans and purpose are
not your plans and purpose for the nation of Israel -

And yet you nod and yet you smile and yet you say among the churches of
America - It is well and good - And I tell you this day America - I hold you
in the scales for what is about to come upon my nation Israel - And you have
been found wanting

And yet you say - It is not popular to address these things - let us walk in
wisdom and let it be - and yet by your very omissions - you have granted the
enemy the power to rule - And I hold you accountable for the omissions of my
church America

For all is not well says the Lord and all is not good - For I have seen the
commissions and the dealings - for the oil and for the wealth of nations
that have changed hands behind secret doors - and I have seen the cloaking
and the hidden agreements that laid the foundations for the pact of death -
yes - even in the Whitehouse - I have seen and I have heard - and my hand is
against it and yet you say America supports Israel - but I tell you church -
that this next season lies at America's door - and I call you America
REPENT - I call you America REPENT - Repent for the fo rsaking of my people
for expediency - REPENT"





And somehow I knew that even as President Bush espoused the deals between
Israel and America - that I sensed the huge outcry against him and against
his office in the wake of Hurricane Katrina - was a warning from Almighty
God to repent at the highest levels of government before his office was
rejected by God himself.

(Please understand how hard this is for me to write as I have always been a
strong advocator of this Presidency but it seemed as though I saw him seated
at his desk - and when it came to issues of Israel I saw a black blindfold
that completely covered his eyes and was tied tightly at the back of his
head - and also that his ears were stopped by a cacophony of sounds - I saw
a HUGE VICE literally pressurizing him down and then I saw that ONLY the
CHURCH had the capacity to lift this terrible weight of the vice away from< br />crushing his shoulders and chest - the VICE was the pressure bought to bear
upon him re the issue of Israel - PUBLIC OPINION - STATUS QUO - EXPEDIENCY -
OIL - and I realized that the Lord was not holding President Bush
accountable alone - but was holding the CHURCH accountable because they were
the called ones WITH THE ABILITY to lift the pressure of the vice OFF the
Presidents neck by their own strong VOICE being lifted up in America - but
there was hardly a whisper of the churches voice -only a few lone voices
reached t he presidents ear - but the words more often than not seemed to be
stolen away by buzzing gnat like looking creatures before they could
actually take root - and the President continued to be crushed by the weight
and pressure of the vice.)

And then my attention was drawn to another strange and almost insignificant
fact - and yet suddenly it seemed to be not at all insignificant - it was
the fact that Condeleeza Rice - the voice and the Whitehouse vocal
propagator of the disengagement of Gaza and the roadmap was born in the
South in Alabama - and was at a church service grieving for her people - And
I knew that the pain she had felt for her people was a shadow to what the
God of Israel felt for the Nation of Israel . And somehow with a terrible
certainty I felt it was connected - a direct result of judgement.

And I felt the burden and the grief -this time of the Lord Jesus Christ -
for all the dispossessed and the homeless and the grieving in New Orleans

And how He loved them and grieved for them - And then he showed me - The
entire body of Christ in America who were mobilizing aid and assistance and
prayer and support in the most incredible manner - And I knew this was in
His eyes truly noble and honorable and that the Church has yet to shine and
will still be a tremendous witness in this hour - B UT THEN He said weeping -

"My Church have been blinded and sidelined as to the REAL ISSUE at stake
here - and therefore are excluding it from their view

And I frowned at the Lord - looking back to the horrific scenes on the Gulf
Coast - the total focus of my attention being there ALSO -



And I saw Jesus literally walk in front of the people trying to move their
attention from the horrific scenes o f the New Orleans disaster onto the
scenes of the future - of the dying screaming people of the second
holocaust - and He was weeping - and as the congregations noticed Him - they
would smile at Him - some even clutched onto Him - but ALL seemingly without
exception had their total focus on the present disaster in America - not
even recognizing that the major connection with judgement was the ACTION of
the American Government to ISRAEL and the horror of the turning of the
IGNITION KEY that wo uld lead to the UNIMAGINABLE - A HOLOCAUST WORSE THAN
THE FIRST HOLOCAUST in years to come

And then the Lord talked of conversations from some in His church that were
saying - "It must be the Lord in Israel - He has allowed THE GAZA
disengagement" And I realized that I TOO was guilty of this talk - and of
this omission over the disengagement of Gaza - not REALISING the ENORMITY of
the CONSEQUENCES - the tiny red hot needle that seemed so insignificant yet
was t he initiator of a covenant of deathFinally Jesus stood quietly

President George W. Bush today about the presence of US troops in Iran:

    & nbsp; Recently, it has been reported that U.S. troops are conducting
military operations in Iran. If true, it appears that you have already made
the decision to commit U.S. military forces to a unilateral conflict with
Iran, even before direct or indirect negotiations with the government of

the U.S. Congress.

    & nbsp; The presence of U.S. troops in Iran constitutes a hostile act against
that country. At a time when diplomacy is urgently needed, it escalates an

Appeals Court Slaps L.A. Over Arrests of Homeless

Los Angeles' policy of arresting homeless people for sitting, lying or
sleeping on public sidewalks as "an unavoidable consequence of being human
and homeless without shelter" violates the constitutional prohibition
against cruel and punishment, a federal appeals court ruled today.

The U.S. 9th Circuit Court of Appeals, in a 2-1 decision, decided in favor
of six homeless persons, represented by the American Civil Liberties Union
of Southern California. The suit challenged the city's practice of arresting
persons for violating a municipal ordinance, which states that "no person
shall sit, lie or sleep in or upon any street, sidewalk or public way."



The appeals court ruled that the manner in which the city has enforced the
ordinance has criminalized "the status of homelessness by making it a crime
to be homeless," and thereby violated the 8th Amendment to the U.S.
Constitution.

City officials had no immediate comment on the ruling, but it appeared that
the decision could have significant ramifications for the city's policy on
the burgeoning problem of homelessness.

In her ruling, Judge Kim McLane Wardlaw said that Los Angeles' Skid Row has
the highest concentration of homeless individuals in the United States. She
said that about 11,000 to 12,000 homeless people live in Skid Row, a
50-block area, bounded by Third, Seventh, Main and Alameda Streets.

"Because there is substantial and undisputed evidence that the number of
homeless persons in Los Angeles far exceeds the number of available shelter
beds at all times, including on the night" the plaintiffs were arrested or
cited, "Los Angeles has encroached upon" the plaintiffs' 8th Amendment
protections "by criminalizing the unavoidable act of sitting, lying or
sleeping at night while being involuntarily homeless," Wardlaw wrote.

Her lengthy opinion states that the Los Angeles ordinance "is one of the
most restrictive municipal laws regulating public spaces in the United
States. The city can secure a conviction under the ordinance against anyone
who merely sits, lies or sleeps in a public way at any time of day."

She added: "Other cities' ordinances similarly directed at the homeless
provide ways to avoid criminalizing the status of homelessness by making an
element of the crime some conduct in combination with sitting, lying, or
sleeping in a state of homelessness."

Wardlaw cited numerous reports on the homeless situation in Los Angeles,
including one written by city officials, which said "the gap between the
homeless population needing a shelter bed and the inventory of shelter beds
is severely large."

Consequently, the judge noted, "for many in Skid Row without the resources
or luck to obtain shelter, sidewalks are the only place to be..The evidence
supports the reasonable inference that shelter is unavailable for thousands
of homeless individuals in Los Angeles on any given night."

The judge said that evidence introduced in the case, entitled Edward Jones
v. City of Los Angeles, showed the plaintiffs "are not on the streets of
Skid Row by informed choice."

Wardlaw said that "as a result of the expansive reach of the [Los Angeles
ordinance], the extreme lack of available shelter in Los Angeles, and the
large homeless population, thousands of people violate the Los Angeles
ordinance every day and night, and many are arrested, losing what few
possessions they may have."

It is very unusual for a plaintiff to win a case based on the 8th Amendment
to the Constitution, which bars cruel and unusual punishment. Courts,
including the U.S. Supreme Court, frequently rebuff challenges based on the
8th Amendment. For example, in recent years the high court had rejected 8th
Amendment appeals challenging long sentences for minor crimes stemming from
three strikes laws.

However, in this instance, Judge Wardlaw analogized to earlier rulings,
which said the mere act of being a drug addict or an alcoholic is not a
crime.

In 1962, the Supreme Court, in Robinson v. California, reversed the
conviction of a California man who had been convicted of violating a state
law which made it a criminal offense to "be addicted to the use of
narcotics."

At the time, the high court, said, "it is unlikely that any state at this
moment in history would attempt to make it a criminal offense for a person
to be mentally ill, or a leper, or to be afflicted with a venereal
disease.In the light of contemporary human knowledge, a law which made a
criminal offense of such a disease would doubtless be universally thought to
be an affliction of cruel and unusual punishment."

The Supreme Court said the California statute at issue clearly was in the
same category, noting that the lawyer for the state acknowledged that
narcotic addiction is an illness.

In today's decision, Judge Wardlaw said at the very least the Robinson case
"establishes that the state may not criminalize `being'; that is, the state
may not punish a person for who he is, independent of anything he has done."

More than 40 years later, Wardlaw said, that case stands for "the
proposition that the Eighth Amendment prohibits the state from punishing an
involuntary act or condition if it is the unavoidable consequence of one's
status or being."

Wardlaw scoffed at the position Los Angeles officials took in the case.

"The City.apparently believes that [the plaintiffs] can avoid sitting, lying
and sleeping for days, weeks, or months at a time to comply with the City's
ordinance, as if human beings could remain in perpetual motion. That being
an impossibility, by criminalizing, sitting lying, and sleeping, the City is
in fact criminalizing [the plaintiffs] status as homeless individuals,"
Wardlaw wrote.

Mark Rosenbaum, legal director of the American Civil Liberties Union of
Southern California, hailed the ruling "as the most significant judicial
decision involving homelessness in the history of the country. The case
stands for the proposition that in America homelessness is not a crime."

"An individual can choose not to rob a bank, but where an individual is
homeless and there are not available beds that individual is in constant
violation of this ordinance with no way to establish his or her innocence,"
Rosenbaum said. "If a homeless person commits a theft, that, of course, can
be prosecuted."

But the way the Los Angeles ordinance was being enforced individuals were
being criminalized solely because they did not have a place to live,
Rosenbaum said.

"I think what community leaders need to do now is deal with the problem, not
by criminalizing homelessness, but by developing shelters, mental health
programs and jobs," Rosenbaum said.

"That's not only humane, it is economically and socially wise. Once they do
that, so many other social problems in the community," will be alleviated,
including the high population in the county jail and pressure on emergency
health services and foster care, he added.

Elerly Woman Ticketed for Walking Too Slowly

LOS ANGELES -- An 82-year-old woman has received a $114 ticket for taking
too long to cross a street in the San Fernando Valley, Calif.

Mayvis Coyle said she began shuffling with her cane when the light was
green, but was unable to make it to the other side before it turned red.

"It turned red before I could get over. There he was, waiting, the
motorcycle cop," Coyle told the Los Angeles Daily News. "He said, `You're
obstructing the flow of traffic."'

Coyle is only one of seniors at Monte Vista Mobile Estates that are upset
over signals they think are too short to safely cross five lanes of traffic,
the Daily News reported.

At least one of the seniors reportedly calls a cab just to cross the street.

Coyle told the paper that she has been fighting her ticket. She doesn't have
a vehicle or a telephone, and said she was carrying her groceries home when
she got the ticket.

"I think it's completely outrageous," Coyle told the paper. "I can't walk
without a stick and I lose my balance.

"He treated me like a 6-year-old, like I don't know what I'm doing. I'm in
shock that somebody's going to stop me on a green light while crossing the
street."

Los Angeles police Sgt. Mike Zaboski of the Valley Traffic Division said
police are cracking down on people who improperly cross streets because
pedestrian accidents are above normal. He said he could not comment on
Coyle's ticket other than to say that it is her word against that of the
citing officer, identified only as Officer Kelly.

"I'd rather not have angry pedestrians," Zaboski said. "But I'd rather have
them be alive."
Others, however, supported Coyle's contention that the light in question
doesn't give people enough time to cross the busy, five-lane boulevard.

"I can go halfway, then the light changes," said Edith Krause, 78, who uses
an electric cart because she has difficulty walking.

On Friday, the light changed too quickly even for high school students to
make it across without running. It went from green to red in 20 seconds.

Had a fall

  Hi All, have had a fall, nothing serious just stiff and sore.  Went to take a photo towards the top end of my bed in which I had re arranged something, and then when I got the camera and went to sit on the bed forgot where I was and sat on the end and ended up on the floor.  All the right side of me is a little stiff and sore etc.  Not sure how I will be for the next few days, alright. Equipping the Armies of Compassion

President Bush established the Faith Based and Community Initiative to "rally America's armies of compassion and restore a spirit of caring, citizenship, and community." The Faith Based Initiative has enabled our armies of compassion to assist many of those whom Jesus called "the least of these, my brothers."

Along the way, some of the groups that are very effectively serving the least of these have struggled to figure out how to obtain funding to expand their work. There is concern that small, church-based groups may sometimes be squeezed out by programs that may not be particularly effective at helping people but are very adept at applying for grants. Most churches and small neighborhood ministries are not familiar with the maze of the grant application process and they have no way to measure the effectiveness of their programs. Fortunately, two groups are helping small churches and faith-based groups assess their impact on those they serve and teaching them how to navigate the grant-making process. They are equipping the armies of compassion.

Assessing Effectiveness. The Acton Institute's Center for Effective Compassion has developed the Samaritan Guide, a fabulous tool that helps organizations assess their effectiveness. The Guide is based on Marvin Olasky's Seven Principles of Effective Compassion, which he developed by studying proven ways to help at-risk people. The Samaritan Guide is easy to use, and provides an accurate assessment of how successful your program is at changing the lives of the people you serve. It also gives suggestions on ways to improve your program. The site has a database of other programs that have been evaluated, so you can see what is working for them, and also includes a map listing groups near you.

There are two added benefits of using the Samaritan Guide. First, the results of the survey will impress grant makers as they assess the effectiveness of your program and your financial, administrative, and stakeholder information. Secondly, you can apply to be considered for the Good Samaritan Award, which is presented each year to the ten most effective programs that practice effective compassion. The top award is $10,000. Applications are open from May 1 to June 30. Profiles of this year's Samaritan Award recipients can be found here.

Karen Woods, the director of the Center explains that the award has two purposes, "We want it not only to reward effective charities, but also to teach other private charities how to become more effective themselves."

Competing for Grants. The second organization making a huge difference for small, faith-based groups is We Care America (WCA), which has established the National Grant Center to help churches and ministries effectively compete for funds.

WCA offers a monthly e-Newsletter, a DVD training kit for Faith-Based Grant Writers, a digital library of the National Grant Writer's Briefing, free conference calls for updates on the Faith Based Initiative, and an eBook: "Grant Teams That Win," written by WCA's Vice President of Grants, David Mills.

Their website has a wealth of information including faith based links, funding resources, forums and news on faith based initiatives, resources on volunteerism and a calendar of faith based conferences and training.

WCA will help you find out how to receive up to $50,000 for capacity building from the Administration of Children and Families' Compassion Capital Fund. WCA's National Grant Center will hold a web briefing on what the Fund is looking for, an insider's guide to the request for proposals, and tips on submitting an application. This briefing will be held on April 5 at 1:00 p.m. EST.

Changing Lives. Dr. Martin Luther King, Jr. said that, "To change someone, you must first love them, and they must know that you love them." If you and your church are providing love and help to "the least of these" you will find the resources provided by the Center for Effective Compassion and We Care America very useful in your important work.

(CBS4 News) FT. LAUDERDALE The January homeless beating death of Norris Gaynor in Ft. Lauderdale did not go unnoticed after all, at least not by the account of a man that came forward to police 30 hours after the deadly crime occurred.

CBS4’s Art Barron has the interview with Anthony Clarke, a Miami man who says he was walking down the park in the early morning hours of January 12th. He had gone out to Ft. Lauderdale that night before he witnessed the beating take place.

However, he did not report the crime right away.

“The guilt made me come back to the scene you know, and wish I could do it all differently if I could do it again,” said Clarke.

The prosecution is buying his testimony. He says he came forward when he realized the gravity of the situation by seeing television news reports that Gaynor had died.

“What made me stop is because I had seen him standing there with a baseball bat,” he said. “I saw the individual with the afro - that's how I recall it - strike the individual on the bench,” said Clarke.

The only teen out of the group with long hair was Thomas Daugherty. Clarke says he was the only teen he saw beat the victim, while the other two accomplices watched.

Clarke later identified Daugherty out of a police line-up. He also said he another suspect, later identified as William Ammons with something else in his hands but not a baseball bat. The other two teens were on either side of Daugherty.

Clarke did have an arrest warrant for driving with a suspended license at the time of the incident, but prosecutors testified on his behalf and got the charges dropped.
